Why Legal Paternity Matters

A name on a birth certificate doesn’t legally establish paternity in Minnesota. Only a signed Recognition of Parentage or a court order does that. Until one of those exists, the consequences for everyone involved are significant.

For the Child

Minnesota law provides two paths to establishing paternity: a Recognition of Parentage (ROP) or a court-based paternity action.

Recognition of Parentage

The ROP is a notarized document signed voluntarily by both parents and filed with the Minnesota Department of Health. When both parents agree and no competing presumptions exist, this document establishes legal parentage without court involvement. What it doesn’t do is grant the father custody or parenting time, nor does it set child support. Those issues require a separate proceeding. An ROP can be challenged in limited circumstances, including fraud, duress, or material mistake of fact, generally within one year of signing or within six months of receiving a genetic test showing an error.

Paternity Action in Court

When paternity is disputed or one parent won’t sign, a paternity action must be filed in the district court where the child or other parent lives. Hennepin County Family Court handles these filings. The court can order DNA testing, and if the results confirm a biological relationship, it issues an order of filiation formally establishing legal fatherhood. Either parent may file, and Hennepin County Child Support Services can also initiate an action when support services are requested.

Custody, Parenting Time & Child Support After Paternity Is Established

Those issues closely parallel what arises in a divorce: legal custody, physical custody, parenting time schedules, and child support. Minnesota courts apply the best interests of the child standard when making these determinations, weighing factors such as stability, emotional ties, and each parent’s capacity to provide care.

Child support is calculated under Minnesota’s guidelines based on both parents’ incomes and the parenting time arrangement. The court may also address child care costs and medical support. A mother may seek retroactive support covering a period before the court’s order, subject to Minnesota law limits. Paternity orders, like divorce decrees, can be modified later if a substantial change in circumstances warrants it.
